After years of discussion, the Unitary Patent (UP) and the Unified Patent Court (UPC) are a reality on 1 June 2023.

Unified Patent Court

The creation of the UPC marks a major step towards an integrated European industrial property system.

This court has jurisdiction to settle disputes relating to :

  • Unitary and "classic" European patents,
  • supplementary protection certificates (SPCs) based on a unitary or “classic” European patent, and
  • applications for European patents.

This new court has its own rules of procedure for ruling on the validity of European patents and infringement.

The decisions rendered are applicable in 17 States, including France, Germany and Italy, when it comes into force.

Representation before the UPC

Before this new court, parties may be represented by lawyers.

They will also have the possibility to be represented by European patent attorneys with appropriate additional qualifications.
